1. Scope & provider

These terms apply to all services of Monica Adela Kohl, Body & Mind Reset (Werastraße 44, 88045 Friedrichshafen, Deutschland).

2. Services

Services include breathwork and nervous-system sessions (individual, group, retreat) as well as offerings for hotels and companies. They serve relaxation, self-regulation and personal development. They are not a medical or psychotherapeutic treatment and do not replace one.

3. Conclusion of contract

Deep Reset sessions (one-to-one and group) can be booked online via the booking tool Calendly. You choose a date, enter your details, confirm the safety note and these terms, and pay the price directly at booking. The contract is concluded once payment is complete and you receive the booking confirmation by e-mail. All other offerings (Reset groups, Total Reset, retreats, hotels and companies) are requested by e-mail or WhatsApp; there, the contract is concluded upon my confirmation.

4. Prices & payment

The prices stated at the time of booking apply as final prices. As a small business (§ 19 UStG, German VAT Act), no VAT is shown. For online bookings, payment is made at booking via the payment provider Stripe. Depending on your device, credit card, debit card, Klarna, Apple Pay and Google Pay are available. For bookings by e-mail or WhatsApp, I will let you know the payment method.

5. Cancellation & rescheduling

You can cancel or reschedule a booked session free of charge up to 48 hours before it starts, via the link in your booking confirmation or by writing to info@atemreset.com. I will then refund the full amount to the payment method used at booking. For cancellations less than 48 hours before the start, or in case of no-show, no refund is possible. Different terms may apply to retreats and to offerings for hotels and companies and will be communicated in advance.

6. Group sessions & minimum group size

Deep Reset groups take place from 5 participants, with a maximum of 8 places. If fewer than 5 bookings have been received 7 days before the date, I cancel the session and inform you by e-mail. You then receive a full refund. The same applies if I have to cancel for other reasons (e.g. illness). Reset groups (60 minutes) and Total Reset take place on request and are arranged individually.

7. Right of withdrawal for consumers

For services scheduled for a specific date (leisure activities, § 312g (2) no. 9 BGB, German Civil Code), no statutory right of withdrawal exists. Where a right of withdrawal nevertheless applies, the following instructions apply.

Withdrawal instructions

Right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded. To exercise your right of withdrawal, you must inform me (Monica Adela Kohl, Werastraße 44, 88045 Friedrichshafen, Germany, e-mail info@atemreset.com, phone +49 173 2457877) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an e-mail). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal. If you withdraw from this contract, I shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which I am informed about your decision to withdraw from this contract. I will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. If you requested that the service begin during the withdrawal period, you shall pay me an amount which is in proportion to what has been provided until you have communicated to me your withdrawal from this contract, in comparison with the full coverage of the contract.

Early expiry. The right of withdrawal expires once the session has been fully performed and you have expressly agreed beforehand that I begin before the withdrawal period ends. If your session falls within the withdrawal period, you request this early performance with your booking. The cancellation terms under section 5 apply independently of the right of withdrawal.

Model withdrawal form. If you wish to withdraw from the contract, please complete and return this form: To Monica Adela Kohl, Werastraße 44, 88045 Friedrichshafen, Germany, e-mail info@atemreset.com. I hereby give notice that I withdraw from my contract for the provision of the following service: (name of session and date). Booked on: (date). Name: (name). Address: (address). Date and signature (only if this form is notified on paper).

8. Health & participation

Participation is at your own responsibility. Intense, connected breathing techniques are powerful and unsuitable in certain cases, including pregnancy, cardiovascular conditions, epilepsy, retinal detachment, severe psychiatric conditions and recent surgery. In such cases, prior medical clearance is required; participation may be excluded or possible only by arrangement. By booking, you confirm that none of these apply or that medical clearance has been obtained.

9. Liability

I am liable without limitation for damage arising from injury to life, body or health and in cases of intent or gross negligence. Otherwise liability is limited to foreseeable damage typical of the contract. Any further liability is excluded.

10. Final provisions

German law applies. Should any provision be invalid, the validity of the remaining provisions remains unaffected.
